Costa Rica Civil Union
Civil union is a concept that has different perspectives and has been subjected to a lot of controversies owing to morals of people from different places. Many have qualms accepting this form of a partnership that goes beyond the traditional coupling of a man and a woman. Many countries have accommodated this concept b putting in place the proper laws to facilitate and empower same sex couples. Costa Rica is yet to develop laws that are in favor of civil unions due to its traditional catholic population.
Civil union in the Costa Rica for the same sex has not been approved yet. Many efforts have been put into this aspect in the past as well as recent times. The legislative assembly is still considering the laws regarding to civil union concerns. A greater flexibility and acceptance for the same sex marriage has been given a push with a bill passed on by The Diversity Movement which is a well known group for the gay community. The bill has been passed on to the legislative assembly in order to achieve recognition and more power to same sex couples in Costa Rica.
The Supreme Court in Costa Rica has been subjected to rule on this issue and has not ruled in favor in making same sex marriages legal. This is a subject that has seen many controversies over the years in order to achieve legal status to empower same sex couples and get the same rights as normal couples. This can be credited to the catholic influence that is present in the country. The issue has resurfaced on more than one occasion with suggestions for it to be included in the family law section. No such verdict has been passed as yet and same sex civil union is yet to gain legal status.
A proposed referendum was created by several groups that were against same sex marriages and put forward to the concerned authority in Costa Rica. This led to stiff competition from several quarters. The requisite course of action was undertaken by the opposing groups and led to the submission of said referendum to the Supreme Court. This was done in the year 2010 to get the Supreme Court to act on the matter and put an end to civil union in the country.
The validity of this referendum was subjected to due consideration by the Supreme Court at the behest of various groups and organizations such as the Ombudsman Office of Costa Rica. The referendum was disbarred by the Supreme Court which has come as a boon for civil union lobbyists as it would completely crush the movement if the referendum had been passed. It has been declared completely unconstitutional and keeping in view the negative factors that already exist for same sex couples, it would be increases the chances of discrimination against such couples.
